1. Agreement to these terms
By downloading, accessing, purchasing through, or using PinSpark, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service. If you use PinSpark for an organization, you represent that you have authority to bind that organization.
The mobile app is licensed, not sold. On Apple platforms, Apple’s Standard Licensed Application End User License Agreement governs the app license and these Terms govern the PinSpark service. If these documents conflict about the app license, Apple’s Standard EULA controls for that license.
2. Eligibility
You must be legally able to enter into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. PinSpark is not directed to children under 13.
3. Accounts
Some features require an account through an available sign-in provider. You are responsible for activity under your account, for protecting access to your device and sign-in provider, and for keeping your information reasonably current. Do not share, sell, or transfer your account. Notify us promptly if you believe it has been compromised.
4. Location-aware service and safe use
PinSpark uses device location and motion information, with your permission, to select nearby content and adapt trips. Coverage, location readings, routes, boundaries, place details, and triggers may be inaccurate, delayed, or unavailable.
Stay aware of traffic, terrain, private property, posted restrictions, and your surroundings. Do not interact with the screen while driving or where doing so is unsafe or unlawful. PinSpark is not a navigation, emergency, safety, accessibility, or professional-advice service. Never rely on it for directions or urgent assistance.
5. Stories and other content
PinSpark stories may be generated or transformed with artificial intelligence and may draw on third-party sources. We aim to provide engaging, grounded content, but stories, translations, images, narration, maps, and place information may contain errors, omissions, outdated material, disputed accounts, legends, or synthetic media. Source links are provided where available so you can learn more.
Content is for general information and entertainment, not legal, medical, financial, historical, travel-safety, or other professional advice. You are responsible for how you use it.
6. Purchases, credits, passes, and memberships
Paid products may include consumable credits, non-renewing passes, and an auto-renewing monthly membership. Current products, benefits, duration, localized prices, taxes, trial terms, and renewal details are shown in the app and by the applicable app store before purchase.
- Store billing. Apple or Google processes payments under your store account and its terms. Store rules govern billing, cancellation, and refund requests.
- Auto-renewal. A monthly membership renews and your store account is charged unless you cancel in store subscription settings within the time stated by the store. Deleting PinSpark or your PinSpark account does not itself cancel a store subscription.
- Credits. Credits are limited, revocable digital service units. They have no cash value, cannot be transferred or sold, and are not property. Purchased and promotional credits do not expire under PinSpark’s current rules, but may be adjusted for refunds, chargebacks, fraud, or correction of an error.
- Passes. A 3-day or 7-day pass is non-renewing and provides the benefits shown for its stated period. A pass purchased while another membership is active may begin when the active period ends.
- Fulfillment. A purchase benefit is applied after the store transaction is verified. If fulfillment is delayed, PinSpark may retry verification or ask you to restore purchases.
Except where law or store policy requires otherwise, purchases are final and non-refundable. Statutory rights remain unaffected.
7. Sharing
PinSpark may let you create links to selected stories or trips. Anyone with a link may be able to view the shared content. Only share content you are comfortable making available, and do not use sharing to violate another person’s privacy, safety, or rights. You may stop sharing a trip link in PinSpark, though copies already made by others may remain. PinSpark does not currently provide an in-app control to revoke a standalone story link.
8. Acceptable use
You may not:
- break the law or infringe another person’s rights;
- harass, threaten, stalk, deceive, or endanger anyone, including by misusing location or shared content;
- probe, disrupt, overload, bypass, or gain unauthorized access to the service, accounts, security controls, or usage limits;
- use bots, scraping, or automated means to access the service except where we expressly permit it;
- reverse engineer or copy the app except to the extent applicable law expressly allows; or
- resell, transfer, or commercially exploit PinSpark, its content, credits, or access without written permission.
9. Ownership
PinSpark and its licensors own the app, service, branding, design, software, and PinSpark-provided content, subject to rights in third-party source material. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. No other rights are granted.
If you send feedback or suggestions, you permit us to use them without restriction or compensation, without identifying you publicly unless you agree.
10. Third-party services
PinSpark relies on app stores, sign-in providers, maps, source websites, AI and speech providers, and other third-party services. Their terms and privacy policies may apply to your use of their services. We do not control and are not responsible for third-party services, content, availability, or practices.
11. Changes and availability
We may add, change, suspend, or discontinue features or content. We do not promise that PinSpark will always be available, error-free, or compatible with every device, region, language, or network. We may update these Terms and will post the revised version with a new date. If a material change requires notice or consent, we will provide it as required by law.
12. Suspension, termination, and account deletion
You may stop using PinSpark at any time and may request account deletion as described in the Privacy Policy. We may suspend or end access if you materially violate these Terms, create risk or harm, or if needed to comply with law. Where appropriate, we will provide notice and an opportunity to appeal.
Provisions that by their nature should survive termination—including ownership, payment records, disclaimers, limits of liability, and dispute provisions—will survive. Store subscriptions must be canceled separately through the applicable store.
13. Disclaimers
To the maximum extent permitted by law, PinSpark is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant the accuracy, safety, reliability, or availability of any story, location trigger, map, narration, translation, recommendation, or third-party content. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, PinSpark and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from the service. PinSpark’s total liability for claims relating to the service will not exceed the greater of the amount you paid to PinSpark through the applicable app store during the 12 months before the claim or US $100. These limits do not exclude liability that cannot legally be limited, and mandatory consumer protections remain unaffected.
15. Disputes and general terms
Before filing a claim, please contact us and give us a reasonable opportunity to resolve it informally. Applicable law governs these Terms, subject to any mandatory rights and forums available where you live. If one provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or sale of the service.
